Saya ingin memaklumkan kepada Dewan yang mulia ini terhadap pembentukan Lembaga Rayuan yang baru
1. Lembaga Rayuan
Lembaga Rayuan merupakan sebuah badan berkecuali (independent body) yang ditubuhkan dibawah Bahagian VI, Seksyen 36 Akta Perancangan Bandar dan Desa 1976 (Akta 172) bertujuan untuk mendengar rayuan daripada pihak awam yang terkilan dan tidak berpuas hati dengan keputusan yang telah dibuat oleh Pihak Berkuasa Perancangan Tempatan.
Pengerusi Lembaga Rayuan yang lama, Dato Ho Mei Ching, telah dilantik sebagai Pesuruhjaya Kehakiman Mahkamah Tinggi Alor Setar dan ekoran perletakan jawatan beberapa ahli-ahli Lembaga Rayuan, maka Kerajaan Negeri telah membuat rombakan terhadap komposisi keahlian Lembaga Rayuan.
Kerajaan Negeri telah melantik Yang Arif Dato’ Abd Rahim bin Uda (Hakim Mahkamah Tinggi Pulau Pinang) sebagai Pengerusi, Puan Siti Khadijah (bekas Pengerusi Mahkamah Perusahaan Pulau Pinang yang kini telah bersara) sebagai Timbalan Pengerusi serta ahli-ahli lain seperti mana yang telah diperuntukan dalam Akta Perancangan Bandar dan Desa 1976. Perlantikan ini telah diwartakan pada 26 Mac 2009 dan berkuatkuasa pada 1 April 2009. Tempoh perlantikan adalah selama 3 tahun. Panel Lembaga Rayuan dijangka mengadakan prosiding yang pertama yang pertama pada 28-4-2009.
Terdapat satu perubahan paradigma dari segi perlantikan ahli-ahli Lembaga Rayuan di bawah Kerajaan Pakatan Rakyat berbanding perlantikan di bawah Barisan Nasional.
Senarai ahli-ahli lama termasuk :
1. Setiausaha Barisan Nasional Pulau Pinang
2. Ahli Jawatankuasa Perhubungan Negeri Parti Gerakan Rakyat Malaysia
3. Ketua UMNO Cawangan Sungai Ara
4. Bendahari UMNO Permatang Pauh
5. Timbalan Pengerusi MIC Cawangan Farlim.
Saya tidak menafikan mereka mempunyai kelayakan dalam profesion masing-masing. Tetapi, hakikatnya perlantikan adalah atas kuota parti politik. Walau bagaimanapun, ahli-ahli panel lama tersebut telah meletak jawatan sejurus selepas Pakatan Rakyat menerajui kepimpinan di Pulau Pinang.
Ahli-ahli panel yang baru yang dilantik oleh Kerajaan Negeri terdiri daripada Engineer, Surveyor, Architect, Lawyer, Academician yang bebas dan berkecuali.
Inilah paradigm shift yang dimaksudkan. Kerajaan Negeri Pulau Pinang akan sentiasa memberi komitmen ke atas pelaksanaan Lembaga Rayuan di Negeri ini terutamanya dalam menyediakan jentera pelaksanaan yang lengkap dengan peralatan dan tenaga pengurusan yang terdiri daripada kakitangan profesional dan sokongan.
2. Jumlah Rumah yang siap dibina pada tahun 2008
Saya juga ingin melaporkan kepada Dewan yang mulia ini.
Secara umumnya sebanyak 13,016 merangkumi pelbagai pemajuan telah mendapat Sijil Layak Menduduki bagi tahun 2008 bagi seluruh negeri Pulau Pinang.
Pecahan bagi semua projek tersebut adalah seperti berikut :

3. Legislative Reform
Beberapa ADUN termasuk ADUN Seberang Jaya, Bukit Tengah, Bayan Lepas, Padang Lallang telah membangkitkan isu-isu tentang kelemahan pelaksanaan COB (Pesuruhjaya Bangunan) dan CCC.
Kedua-dua isu ini melibatkan pelaksanaan Akta Parlimen.
Bagi memastikan penyelenggaraan flat-flat sentiasa teratur, Kerajaan Negeri melalui penguatkuasa undang-undang di bawah Akta Bangunan Dan Harta Bersama (Penyenggaraan dan Pengurusan 2007) (Akta 663), Pesuruhjaya Bangunan (COB) yang telah dilantik di kedua-dua PBT memainkan peranan dalam menangani masalah-masalah yang timbul di bangunan bertingkat.
Dalam masa yang sama juga, pemilik-pemilik unit perlu memainkan peranan dalam memastikan bangunan tersebut sentiasa dalam keadaan baik. Tanggungjawab tersebut adalah tanggungjawab bersama antara pemaju dan penduduk. Adalah diharapkan juga YB ADUN kawasan juga memainkan peranan dalam membantu Kerajaan Negeri untuk menyelesaikan perselisihan faham antara penduduk-penduduk dalam pembentukan JMB.
Sebagai seorang Legislator, semua ADUN-ADUN dan Ahli Parlimen harus juga memainkan peranan dalam menjalankan inisiatif legislative reform. Terdapat kelemahan di Akta 663 contohnya tiada subsidiary law dan prosedur-prosedur untuk menyokong pelaksanaan Akta 663.
Pihak Kementerian Perumahan dan Kerajaan Tempat telah memulakan langkah consultation dengan stakeholders dan telah meminta badan-badan profesional seperti Badan Peguam, Juru Ukur, Pemaju untuk memberikan input-input.
Oleh itu, saya meminta wakil rakyat mengambil maklum tentang perkembangan itu dan membawa isu-isu legislation reform di forum-forum yang bersesuaian.
Adun Bayan Lepas telah membangkitkan isu CCC dan non-technical requirement. Sekiranya kita melihat kepada Akta, syarat-syarat seperti pelepasan kuota Bumiputera dan 30% low cost housing memang ialah non-technical requirement. PSP hanya ambil maklum tentang keperluan technikal. Niat Parlimen semasa pindaan Akta hanya berkisar tentang technical requirement. Saya bersetuju bahawa terdapat kelemahan dari segi pindaan Akta yang langsung tidak mempertimbangkan isu-isu non-technical yang saya sebutkan. Ini akan mempengaruhi bukan sahaja Pulau Pinang tetapi kesemua negeri di Malaysia.
Sebagai seorang Legislator, semua ADUN-ADUN dan Ahli Parlimen harus juga memainkan peranan dalam menjalankan inisiatif legislative reform.

THE state government has looked beyond the political party quota system to appoint members to the state Appeals Board, State Town and Country Planning and Housing Committee chairman Wong Hon Wai said.
He said the members comprised an engineer, surveyor, architect, lawyer and an academician.
“The previous administration appointed individuals to the board based on their political affiliations,” he said in his winding up speech at the state legislative assembly yesterday.
He said Penang High Court judge Datuk Abdul Rahim Uda and former Penang Industrial Court judge Siti Khadijah S. Hassan were recently appointed the board chairman and deputy chairman respectively.
Jagdeep Singh Deo (DAP – Datuk Keramat) quickly interjected to clarify that the board’s outgoing chairman Datuk Ho Mooi Ching, to his knowledge, was not involved in politics.
Datuk Arif Shah Omar Shah (BN – Seberang Jaya) claimed that the board’s previous members were all professionals, noting that they did not mix politics with their board duties.

World Earth Day: Planting 15 Tecoma trees at Kampung Pisang, Air Itam

Team up to plant more trees, reps urged

PENANG assemblymen should work with the local business community to plant more trees in their constituencies, state Landscape Committee chairman Wong Hon Wai said.
He said they could get local businessmen to finance the purchase of tree saplings.
“This is one way of encouraging the local community to plant more trees in their neighbourhood,” Wong said after planting 15 Tecoma tree saplings at an open space behind the Sunshine Farlim Hypermarket in Kampung Pisang, Air Itam yesterday.
Wong, who is also state Housing and Town and Country Planning Committee chairman and Air Itam assemblyman, said the activity was a joint effort between his service centre and the Penang Municipal Council in conjunction with World Earth Day on April 22.
He also said the state Forestry Department planted some 25,000 tree saplings of various species in the first three months of the year.
Last year, the department planted 54,126 trees all over Penang, he added.
黄汉伟:槟去年植树逾5万棵 今年目标7万5千棵

(槟城17日讯)槟州美化委员会主席兼亚依淡区州议员黄汉伟指出,去年槟州已经成功种植了逾5万棵树,到了今年3月为止,在第一季的报告中显示种植了2万5千棵,不过该会在今年内会继续朝向目标中的7万5千棵前进。
他说,部份植树计划在森林局的努力下,已经成功在红树林植树,不过相信只要在槟威市政局和各政府机关的配合下,未来将有更多的植树计划在州内落实。
今天共有15棵属于(Tabebuia Rosea)的大马樱花种植在甘榜比桑的草场上,必须等待5年后才会开花,这只是首个阶段而已,将来不排除在这邻近一带种植更多大马樱花,将此处发展成为一个休闲地区。
黄汉伟及槟州美化委员会委员郑雨周出席,配合“地球日”在甘榜比桑种植“大马樱花”暨介绍乡村暨治安发展委员会主席的活动上,如是指出。
亚依淡区乡委会集合三大民族
黄汉伟向媒体引荐亚依淡区三个乡委会主席时阐明,亚依淡区是属于非常特殊的地区,无论是从基层如乡委会到国州议员都是集合三大民族并且充满着多元色彩。
他说,甘榜马来油(Kampung Melayu)乡委会主席是由巫裔同胞哈芝曼沙也是回教婚姻副注册官出任,甘榜比桑是谢宝成也是该区警卫队官员,而天德园则由政府公务员拉马林甘出任。
“这种情况是比较罕见和特殊的。”

Penang Appeal Board - new appointments.
The Appeal Board has reached another milestone. It is under my portfolio - Town and Country Planning. The Penang State Government has appointed a new panel of Appeal Boards which comprises professionals and independent citizens.

THE state Appeal Board in Penang will be headed by Penang High Court judge Datuk Abd Rahim Uda.
His deputy is Siti Khadijah S. Hassan — a former industrial court judge. Eleven others, comprising academicians and professionals including a lawyer, engineer, architect and surveyor, have been appointed board members.
“This is an independent body set up under the Town and Country Planning Act 1976. So hopefully, we will be able to strike a balance between the state’s economic development, environmental needs and the concerns of the people in our effort to achieve international city status,” Chief Minister Lim Guan Eng said before he presented the official appointment letters to the board members in Komtar on Friday.
The eight newly appointed board members are Teh Theam Seng, Prof Abdul Ghani Salleh, Lim Yoke Mui, Datuk Tan Chong Meng, P. Ganesh, Datuk Dr Sharom Ahmad, Prof Dr Eric Goh and N. Shanmugam.
Existing members who have been retained are Datuk Dr Ong Hean Tee, Associate Prof Dr Mohamed Amirrudin Fawzi Bahaudin and Rumi J Manecksha.

The three-year appointments took effect on April 1.
Lim said members of the public should discuss their problems with their respective assemblymen before filing an appeal with the board.
“If you have cases that occurred before last year’s March 8 general election, please approach your assemblyman to see if things can be sorted out in a speedier and more efficient manner without resorting to court action.
“Only if that fails, should you approach the board,” he said, adding that all letters sent to the local authorities must be replied so that complainants would be aware of the status of their problems.
“The local councils must also keep all records and correspondence which are to be filed properly to avoid their cases being thrown out by the board on technical grounds,” he said.
In his speech, Abd Rahim said: “We (the board members) are entrusted to do our jobs well. We all come from different backgrounds and all have different experiences which I am confident will serve us well when we are faced with many different issues.”

THE 200-odd families living in temporary long houses in Rumah Hijau, Mak Mandin will be resettled in a new low-cost housing project in Ampang Jajar by the third quarter of the year.
Penang Town and Country Planning and Housing committee chairman Wong Hon Wai said the project developer Silver Channel Sdn Bhd was confident that the 20-storey block would be completed on schedule.
“The developer has said that that the block, which comprises 304 units priced at RM42,000, is now 90% completed.
“Only a service road and some basic infrastructure facilities need to be constructed,” he said after meeting some residents in Rumah Hijau last Friday.

Last week, Rumah Hijau residents organised a peaceful gathering urging the state government to guarantee them replacement flat units in Ampang Jajar.
A resident M. Kesavan, 41, said the residents had suffered hardships for 40 years due to lack of facilities such as clean drinking water and proper sewerage.
Wong said the state Housing Committee, which conducted an inter-agency meeting last Monday, had discussed with the developer on the resettlement formula for the residents.
He said there were four categories of residents — those with and without temporary occupation licence (TOL) as well as original Rumah Hijau settlers and their extended families.
“The developer and I will meet the residents today to explain to them the compensation quantum according to their respective categories,” he said, adding that there were also four grocery shops that needed a proper place to be relocated.
The residents’ representative A. Tamilsalvan, 33, said the residents would hold their own meeting to compile feedback on their problems to be presented to Wong.
“We are thankful that Wong has visited us to see for himself our deplorable living condition,” he said.
Last October, Wong said that the state had entered a privatisation agreement with Silver Channel to build 304 low-cost flat units on a 8.3ha plot in Ampang Jajar.
Under the agreement, he said, the developer would surrender 200 units valued at RM8.4mil to the state for the resettlement of the Rumah Hijau residents. But, since there were 255 families to be relocated, Wong said the state would spend RM4.3mil to buy up the remaining 104 units to ensure there were ample units for the residents.

THE Penang Government has pledged to help residents of Kampung Tanjung Tokong to reach an amicable solution with UDA Holdings Bhd regarding their resettlement and compensation.
State Housing and Town and Country Planning Committee chairman Wong Hon Wai said the residents had until April 15 to forward their input and resubmit names which were left out in the Tanjung Tokong resettlement programme.
The programme’s survey was carried out in July 2003.
Wong said many residents who claimed that they were entitled for resettlement had complained that their names were not in the list released by the company.
“All the proof and requests which are in written form must reach me or Tanjung Bungah assemblyman Teh Yee Cheu by April 15.
“After that, I will forward all the documents to the company. The state government is here to co-ordinate the negotiation between the residents and the company,” he said after a dialogue session with the residents recently.
He said the residents had to show proof such as marriage certificates, MyKads or other relevant documents to back their claims that they are actual residents of Kampung Tanjung Tokong.
The residents had refused to move out of their houses sited on land owned by UDA which wants to develop the area.
